What Is a Consent Order in Family Court?
San Mateo, United States - October 26, 2026 / Viola Law Firm /
Parents in San Mateo who settle custody terms outside court still need a judge's signature to make the agreement a court order. A related post explains how consent orders work in family court and how they differ from other divorce-case orders.
In this release, Viola Law Firm P.C. outlines the court forms and legal requirements that a family law attorney reviews in a custody or support stipulation.
Filing a Stipulation in San Mateo County
Parents can attach a written custody agreement to Judicial Council form FL-355, which the court uses to adopt the agreement as an order. Child support agreements use form FL-350, the Stipulation to Establish or Modify Child Support and Order. Family law cases in the county are generally filed and heard at the Southern Division in Redwood City, under local rules that supplement the California Rules of Court.
How Courts Review Custody Agreements
California's court self-help guide states that parenting plans must serve the children's best interests. Relevant factors include the child's age and each parent's ability to provide care.
Custody terms have two parts: legal custody covers who makes major decisions, and physical custody covers where the children primarily live. Parents can discuss a proposed custody agreement with Viola Law Firm P.C. before filing it.
How Courts Review Child Support Agreements
Parents may stipulate to a child support amount, but the court must approve it. Under Family Code section 4065, a court will not approve a stipulation below the guideline amount unless the parents declare each of the following:
Informed rights: Both parents understand their child support rights.
Voluntary agreement: Neither parent agrees under coercion or duress.
Children's interests: The agreement serves the best interests of the children involved.
Adequate support: The stipulated amount will adequately meet the children's needs.
No county assignment: Support rights have not been assigned to the county, and no public assistance application is pending.
The court’s local rules also require every child support stipulation to include a support calculation printout from software certified by the Judicial Council. A below-guideline stipulation can later be modified to the guideline amount or higher without showing a change of circumstances.
Court Resources for San Mateo County Parents
The Family Law Facilitator's office, which every California superior court must maintain, helps parents complete support forms and, when resources allow, may draft stipulations on issues they have agreed on. The facilitator is a neutral attorney appointed by the court who cannot represent either parent, and communications with the office are not privileged.
The court encourages self-represented parents to meet with the facilitator before filing any documents. A parent who wants representation during negotiations can retain a family law attorney.
